Last Will and Testament

In the name of God Amen I Thomas Birkett of Lambrigg park being infirm of body but of sound mind and memory
praised be God for the same do make and ordain this my last will and testament
in manner and form following (that is to say) I commend my soul into the hands
of almighty God who gave it me and my body to the ground to be decently buried
in hopes of a Joyful Resurrection through the Meritts and by the Mediation of my Blessed
Saviour and Redeemer Jesus Christ, And as for such worldly goods as itt hath pleased God in his
great mercy to bestow upon me I give and devise of them in manner and form following
First I give and bequeath to my dearly beloved wife Abigail Birkett all that my Reale Estate
Lyeing and being at Lambrigg Park Aforesaid consisting of one dwelling house poathouse garden and Orchard during the term of her Naturall life or so
Long as she shall continue my widow together with all my personal estate cattle horses and
sheep household stuff and influence of husbandry she being charged with and paying such legacies
as shall be hereof or mentioned And it is my will and mind that my aforesaid wife whom
I make executor of this my last will and testament do pay and discharge all my just
debts and funeral expenses and then I give and bequeath to my son George Birkett
the sum of eighty pounds item I give to my daughter Isabel Birkett the sum of
thirty pounds item I give to my daughter Anne Birkett the sum of thirty pounds
item I give to my daughter Mary Birkett the sum of thirty pounds all which said severale
legacies it is my will and mind shall be paid to my said children as they attain the age
of twenty one years and in case any of my set children die before that age and without
issue then it is my will and mind that such legacies be equally divided share
and share alike amongst the rest of my surviving children or to their heirs or assigns
and being further will and mind that as soon as my aforesaid son George Birkett shall attain
the age of twenty one years that then the he shall share and divide equally with his mother
my aforesaid executor all my cattle force says sheep household stuff and implements of husbandry
And I do give and bequeath to my said son George Birkett all that my real estate lying
and being at Lambrigg Park before said consisting of one dwelling house poat house garden and
orchard with all the privileges appurtenances for conveniences thereunto belonging after the
death of my aforesaid wife or as soon as she shall cease to be my widow And I likewise give
to my said wife the tuition of my set children with the care and education of them while they shall
attain the age of twenty one years hoping she will faithfully discharge the same
but if in case my said wife shall think it moot and do marry again then it is my
will and mind at all gifts grants privileges and advantages which might arise to her as
executor of this my last will and testament be revoked disannulled and made void she having only
in that case one pair of bedstocks with one bed of close made up after the usual manner
of a widow bed together with such a part or past soul of household stuff as she and the
trustees something named shall think moot and convenient for her the same not to exceed the
value of five pounds And I do hereby name and appoint Richd Ward of High house and Leonard Ewan
of Green Dikes to be trustees of this my last will and testament desiring theyll see the same duely
Executed and it is my will and mind that if my said wife do marry again then it is my mind
that the trustees do take upon them the tuition care and education of my sad children file they
Come to the age of twenty one years being allowed such reasonable expenses in such case
as may be deemed and thought honest and equitable and it is my further will and mind
facts up home an after the death or marriage of my said wife Abigail Birkett that
then my household stuff implements of husbandry with the capital of every sort be
Immediately sold and the money arising there from together with the remainder
of my personal estate undisposed of be equally divided share and share
alike amongst my aforesaid children or to their heirs and assigns (such children
excepted who by their Coilfulness Obstinacy or Disobedience shall render them-
selves incapable and unworthy to receive such further Benefits And it is
my will and mind that such forfeited part shall be disposed of among the other
Children or their Heirs as my aforesd wife and trustees in their prudence shall
Think moot & proper In Wittness that this in My Last Will and
Testament I have hereunto sett my hand and seal this thirteenth Day of May and in the Year of our Lord 1756 in the presence of
we whose names are hereunto subscribed
