Narrative and Notes

Thomas MACHELL married Mary ROWLANDSON in 1803 and they went on to have 9 children baptized nicely bookended between Edward 1805 and Rowlandson 1822.

In 1820 Thomas is living as Whinfell near Kendal. He was clearly a hunting gentleman and wished to protect his game from poachers.

By 1832 Thomas MACHELL was farming Capplethwaite Hall near Killington as a tenant under John Upton Esq.

Capplethwaite Hall is described as "house and barns, nearly 2 m. N.N.E. of the church [in Killington]. The House was re-built in the 18th century, but two rooms have 17th-century panelling refixed. The Barn, S.W. of the house, has a panel with the initials and date I.M. 1714 (NB I.M. could J.M.) and three ranges of loop-lights. Adjoining is a second barn of seven bays. (An Inventory of the Historical Monuments in Westmorland)

In 1841 is was still farming aged 70 at Capplethwaite Hall in Kirkby Lonsdale with his wife Mary and sons Rowlandson and Leonard and many servants.

Thomas MACHELL outlived his sons John and George. John's four children were legatees to Thomas' will, which was probated in 1854. By this time he was living at Grassrigg, a farm 1.5 miles north of Killington.

In his will, after providing for his wife Mary, Thomas gave his son Richard all of his farming stock including his cows, horses, pigs, farming implements, carts, wheels, ploughs, harrows, his tools, furniture, bedsteads, beds, bedding and linen. His daughter Ann COULTHWAITE got the two brass pans and wooden tray. His late son John's four surviving children got £5 each, and late son George's two children got £5 too. His landed property was to be sold and shared between his children Edward, Thomas, William, Richard, Rowlandson, Leonard MACHELL and Ann COULTHWAITE. The total value was assessed at being less than £100, suggesting that the £30 bequeathed to the children of his sons John and George was fair.

Other information:

In Oct 1844 two Thomas MACHELLs and a James MACHELL, all of Staveley (5 miles NW of Kendal) appear in a list of 'Persons who have obtained game certificates for the year 1844'. They cost £4 0s 10d each. This was a different Thomas and Mary MACHELL family whose eldest sons were Thomas and James. In 1847 this Thomas MACHELL of Staveley's hay barn burn down causing £200 of damage including the destruction of a hearse, caused by a 5 year old boy playing with a 'lucifer' match. In 1851 they were living in Over Kellet.

In the Parish of Kirkby Kendal in this County of Westmorland was proved and the evocation thereof committed to John Machell and Thomas Machell the Executors therein named

Died 31 March 1824 Interest under £450

in the Parish of Kirkby Kendal and County of Westmorland

Husbandman being sound disposing Mind, memory and

Understanding and for the better settling of my temporal affairs

Do make publish and declare this my Last will and Testament

In Manner and Form following that is to say I give and

Bequeath unto my Daughter Bella Robinson my household

Furniture of what Nature soever with all my Bedsteads Beds

Bedding and Linen that I may be possessed of at the time

of my decease also my Corner Cupboard now in the Hands of my Son

James Machell then I constitute and appoint my sons

John Machell and Thomas Machell joint Executors to this my

Will and I do hereby give unto them all my Bills Bonds Books

Debts and Securities for Money with all my personal Property

Whatsoever not before disposed of upon special trust and confidence

Subjecting them in the first place to pay and discharge out of this sum

all my just Debts testamentary and funeral Expenses and all

the respective Legacies hereinafter by me bequeathed that is to say

first I give and bequeath to my Son John Machell the sum of

Eighty Pounds then I give and bequeath to my Daughter Bella Robinson

the sum of Eighty Pounds then I give and bequeath to my Son

James Machell the sum of Forty Pounds I also give and bequeath

To my Son George Machell the sum of One Hundred Pounds then

as for the Rest and Residue remaining I give and bequeath the

same jointly to and between my two Son John Machel and

Thomas Machell my said Executors Share and Part alike

then I will order and direct the before mentioned Legacies to

be paid at the End of twelve Months next after my decease

and should any of my Son or Daughter die before his or her

Legacy becomes due the Legacy or Legacies of such dying to go

jointly to and amongst the Issue of such Share and Part alike

and it further is my Will and Mind that if any Loss or

Losses should happen or be sustained by any Person to whom

I have Money out at Interest it is my Will and Mind that

and Legatee is to full so much short in Proportion and

according to the Amount of each respective Legacy before by

me bequeathed and I do revoke and make void all former

and other Will or Wills at any time heretofore by me made

and do declare this my last Will and Testament.

In the Name of God amen, I Thomas Machell

of Greyrigg in the Township of Killington Parish

of Kirkby Lonsdale And County of Westmoreland

Yeoman and farmer being of sound mind memory

and understanding and for the better settling

my temporal affairs do make publish and declare

this my last will and testament in the manner and

form following that is to say Imprimus I give

and bequeath to my wife Mary Mitchell providing

the she survive me the rents are rising from my

landed property situated in Sealthwaiterigg in the

Parish of Kendal and said County of Westmoreland

and the same to be paid to her half yearly by the herein

after named my executor's I also give and bequeath

to her the use of my household furniture and any

interest arising from my farming stock provided

the she continue to reside with my son Richard Machell

one of my hearing after named executors and after

my wife's decease I hereby give and bequeath to

my aforesaid son Richard the whole of my farming

stock that is to say cows, horses, pigs and farming

implements such as carts, wheels, ploughs, harrows

and all other farming implements that I am possessed

of and not hereinbefore mentioned also all my

joiner's tools I also give and bequeath to my son

Richard my household furniture of what nature

so ever with all my bedsteads beds bedding and linen

that I may be possessed of at the time of my decease with

the exception of the three hereinafter mentioned articles

that is to say two brass pans and one wooden tray which

I give and bequeath to my daughter Ann Coulthwaite

and herein I constitute and appoint my sons Richard

and Rowlandson Machell joint executives of this my

last will and testament And I do hereby give unto them

all my deeds securities with all my personal property

whatsoever and wheresoever not before disposed of upon special

trust and confidence subjecting them in the first place

to pay and discharge out of the same all my just debts

funeral and testamentary expenses and all the respective

legacies hereinafter by me bequeathed that is to say

First I give and bequeath to the four children of my late son

John each Five pounds and I give and bequeath to the two

children of my late son George each 5 pounds these

legacies to be paid when the above named my executors

dispose of my landed property I also order that the

above named my executors after my or my wife's

decease shall dispose of my landed property either

in public or private sale and the proof proceeds arising

therefrom to be equally divided Share and share alike

betwixt my six sons and daughters hereinafter men-

tioned that is to say my son Edward Machell,

Thomas Machell, William Machell, Richard Machell,

Rowlandson Machell, Leonard Machell and Ann

Coulthwaite I also order that should the above named

my executives not have a suitable offer made for my

landed property not to dispose of the same for one

or more years after our decease I also order that

the above named my executives shall make such

improvements as they think proper on my landed

property after deducting the necessary expenses

or outlay from the rents arising therefrom, the re-

sidue to be divided equally be twixt my son Edward,

Thomas, William, Richard, Rowlandson, Leonard

Machell and Ann Coulthwaite share and share alike

yearly and every year until a suitable offer be made

I also ordered my son Richard to deduct twenty

five pounds with interest from the date thereof

from the sum that my son Thomas becomes in-

titled to under this my last will and testament for

whose use I borrowed this said amount of my son Richard

and who holds my promissory note for the above

named amount it is my wish and desire as

also of my wife marry after our decease to be in-

terred at the Chapel of Killington and the said

funeral and other incidental expenses appertaining

thereto to be paid by my son Richard and should

any of my sons or daughter die before his or her

legacy becomes due the legacy or legacies of such dying

to go jointly to and amongst the issue of such sons and

daughter share and share alike; and it is further my

will and mind should there any loss or losses happen

from rents or otherwise that each of the legatees do

bear share and share alike.

In witness whereof and confirmation that this is my

last will and testament I hereby subscribe my hand and seal this

seventeenth day of November one thousand eight hundred and fifty two

On the 15th day of June in the year of our Lord one thousand eight hundred and fifty four this will of Thomas Mitchell late of Grass Rigg in the township of Killington and Parish of Kirkby Lonsdale in the County of Westmoreland yeoman who departed this life on the seventeenth day of April one thousand eight hundred and fifty four and was proved in common form and Richard Machell of Grass Rigg aforesaid one of the executives therein named was sworn well and faithfully to execute and perform the same and so with four[??] being [covered] for Rowlandson Machell the other Of the executor's therein named of grass rig afull said and according to the best of the information and belief of the said Richard Mitchell the said executor the whole of the goods chattels and credits of which the said testator Thomas Machel died possessed within The Diocese of Chester and Manchester and Archdeaconry of Richmond in the Diocese of Ripon exclusive of what the said testator might have been possessed of or entitled to as a trustee for any other person or persons and not beneficially and without deducting anything on account of the debts due and arising by or from the set testator were under the value of 100 pounds before me JH Fisher surrogate
