Narrative and Notes

John MACHELL was a farmer and came from a family of farmers.

John married Jane KENDAL in about 1834 and together they had three children: Nancy, Jane and Elizabeth. Nancy was christened in Killington, about 10km East of Kendal, while Jane and Elizabeth were christened in Natland, 3-4km South of Kendal, near to Kendal Parks. Jane had had an earlier child, Mary Ann, in 1833 and it is possible that this was John's 'natural child' born before they married. In John's father's will he left £5 each to "John's four surviving children".

John farmed Kendal Parks Farm where he died and from where his wife Jane remarried from. Kendal Parks Farm lies between the railway lines to the South East of Kendal and still exists today. Before John (in 1829), Kendal Parks was being farmed by James SMITH.

John died of a fever in 1840 when only 29 leaving a wife and four young children. The death was reported to the registrar by Eleanor FAWCETT. Based on this information John MACHELL was born about 1810/11.

John's father was Thomas MACHELL of Caplethwaite Hall, Killington. Thomas left John four surviving children £5 each in his will of 1852. Richard MACHELL, his brother, was farming Gray Rigg, Killington in 1861 and was the main recipient of that will.

I'm sorry it took me so long to get back to you. I've actually been to England twice since the first of August trying to sort out my branch of the Machell family!

I'm now fairly confident that the John Machell who married Jane Kendal was the son of Thomas Machell and Mary Rowlandson. He was christened 14 May 1808 in Kendal. He died before his father, but his four children are legatees in Thomas Machell's will, which was probated in 1854.

Mary Ann (illegitimate daughter of Jane Kendal. She was christened Mary Ann Kendal, but is Mary Ann Machell on her marriage certificate, daughter of John Machell, farmer, deceased.)

Nancy Machell (Nancy was a witness at Mary Ann's marriage to John Stewardson.)

In the Name of God amen, I Thomas Machell

of Greyrigg in the Township of Killington Parish

Yeoman and farmer being of sound mind memory

and understanding and for the better settling

my temporal affairs do make publish and declare

this my last will and testament in the manner and

form following that is to say Imprimus I give

and bequeath to my wife Mary Mitchell providing

the she survive me the rents are rising from my

landed property situated in Sealthwaiterigg in the

Parish of Kendal and said County of Westmoreland

and the same to be paid to her half yearly by the herein

after named my executor's I also give and bequeath

to her the use of my household furniture and any

interest arising from my farming stock provided

the she continue to reside with my son Richard Machell

one of my hearing after named executors and after

my wife's decease I hereby give and bequeath to

my aforesaid son Richard the whole of my farming

stock that is to say cows, horses, pigs and farming

implements such as carts, wheels, ploughs, harrows

and all other farming implements that I am possessed

of and not hereinbefore mentioned also all my

joiner's tools I also give and bequeath to my son

Richard my household furniture of what nature

so ever with all my bedsteads beds bedding and linen

that I may be possessed of at the time of my decease with

the exception of the three hereinafter mentioned articles

that is to say two brass pans and one wooden tray which

I give and bequeath to my daughter Ann Coulthwaite

and herein I constitute and appoint my sons Richard

and Rowlandson Machell joint executives of this my

last will and testament And I do hereby give unto them

all my deeds securities with all my personal property

whatsoever and wheresoever not before disposed of upon special

trust and confidence subjecting them in the first place

to pay and discharge out of the same all my just debts

funeral and testamentary expenses and all the respective

legacies hereinafter by me bequeathed that is to say

First I give and bequeath to the four children of my late son

John each Five pounds and I give and bequeath to the two

children of my late son George each 5 pounds these

legacies to be paid when the above named my executors

dispose of my landed property I also order that the

above named my executors after my or my wife's

decease shall dispose of my landed property either

in public or private sale and the proof proceeds arising

therefrom to be equally divided Share and share alike

betwixt my six sons and daughters hereinafter men-

tioned that is to say my son Edward Machell,

Thomas Machell, William Machell, Richard Machell,

Rowlandson Machell, Leonard Machell and Ann

Coulthwaite I also order that should the above named

my executives not have a suitable offer made for my

landed property not to dispose of the same for one

or more years after our decease I also order that

the above named my executives shall make such

improvements as they think proper on my landed

property after deducting the necessary expenses

or outlay from the rents arising therefrom, the re-

sidue to be divided equally be twixt my son Edward,

Thomas, William, Richard, Rowlandson, Leonard

Machell and Ann Coulthwaite share and share alike

yearly and every year until a suitable offer be made

I also ordered my son Richard to deduct twenty

five pounds with interest from the date thereof

from the sum that my son Thomas becomes in-

titled to under this my last will and testament for

whose use I borrowed this said amount of my son Richard

and who holds my promissory note for the above

named amount it is my wish and desire as

also of my wife marry after our decease to be in-

terred at the Chapel of Killington and the said

funeral and other incidental expenses appertaining

thereto to be paid by my son Richard and should

any of my sons or daughter die before his or her

legacy becomes due the legacy or legacies of such dying

to go jointly to and amongst the issue of such sons and

daughter share and share alike; and it is further my

will and mind should there any loss or losses happen

from rents or otherwise that each of the legatees do

bear share and share alike.

In witness whereof and confirmation that this is my

last will and testament I hereby subscribe my hand and seal this

seventeenth day of November one thousand eight hundred and fifty two
