Narrative and Notes

Robert KENDAL was born in Sedbergh in 1770. He was a husbandman and in lived in Marthwaite, a hamlet in the township and parish of Sedbergh; half a mile from Sedbergh, Yorkshire near the border with Westmorland. The 1829 guide describes Sedbergh thus: "Sedbergh is a small market-town... ...10 miles from Kendal; situated in a secluded and fertile vale, among rugged mountains. The principal manufacture here is cotton, and there is a mill a short distance from the town, at which a considerable number of persons are employed."

Robert married Nancy DICKENSON in April 1811. Robert and Nancy KENDAL probably lived at High(er) Oaks Farm, near Marthwaite, Sedbergh as this is where Nancy was living in 1841-1861. They had thirteen children born between 1811 and 1831.

Robert was the tenant of Richard Willan, Esq, who in 1831 advertised the sale of wood from the Oaks.

We know that Robert had died by the time of his daughter Jane's marriage to John MACHELL, and a burial record in the parish records suggests he died 15 June 1835 aged 65. This tallies with his birth record and a probate record of 20 Sep 1835 containing a administration bond only for a Robert KENDAL of Oakes, Marthwaite, Sedbergh.

This is the last will and testament of me Robert Kendal of Oaks in Marthwaite in the parish of Sedbergh in the West Riding of the County of York Yeoman I give and devise unto my sons Thomas and Robert Kendal all that my estate called Oaks in Marthwaite aforesaid with all the appurtenances thereunto belonging to hold to them the said Thomas and Roberts their heirs and assigns for ever as tenants in common and not as joint tenants charged and chargeable nevertheless And I do give and bequeath thereof unto my sons William John and George and unto my daughter Margaret Alderson each the sum of one hundred pounds to be paid to them or their legal personal representatives at the end of 12 months next after my decease and I do further charge the said estate with the widowright of my dear wife Jane which I strictly charge my said sons Thomas and Robert to pay her quarterly and to well and comfortably support and maintain her during her natural life I give and bequeath unto my daughter Margaret my best featherbed a snap table and a warming pan and all the rest residue and remainder of my few personal estate and effects whatsoever and wheresoever I give and bequeath unto my said two sons Thomas and Roberts and appoint them joint executors of this my will hereby revoking all former and other wills by me made and declaring this only to be my last will and testament in witness whereof of I the said Robert Kendal the testator have hereunto set my hand and seal this seventeenth day of June in the year of our Lord one thousand eight hundred and nine

On the eleventh day of February in the year of our Lord one thousand eight hundred and thirteen this will was proved in common form and Thomas Kendal and Robert Kendal of Oakes in the parish of Sedbergh husbandmen join executors therein named were sworn well and faithfully to execute and perform the same and so forth and that to the best of their knowledge and belief the whole of the personal estate and effects of which the testator within named who departed this life September twenty eight one thousand eight hundred and twelve died possessed within the Archdeaconry of Richmond in the Diocese of Chester did not in real value amount to the sum of 20 pounds
